1. Scope and seller

These terms and conditions apply to all orders you place through the online shop at www.mangohabanero.com. Your contracting party is:

Any conflicting terms of the customer do not form part of the contract unless we expressly agree to them in writing.

2. Age restriction – sales to adults only

We sell alcoholic beverages only to persons who have reached the minimum age required by the law of their place of residence for buying spirits – 18 years in Austria and Germany. By placing an order, you confirm that you have reached this minimum age. Where there is reasonable doubt about your age, we reserve the right to ask for proof of age and to cancel the order. The carrier may make delivery subject to an age check.

3. Conclusion of the contract

The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to order. By submitting your order with the "Buy now" button, you make a binding offer to enter into a purchase contract.

We confirm receipt of your order by email without delay. This confirmation of receipt does not yet constitute acceptance of the offer. The purchase contract is concluded as soon as we expressly confirm acceptance or dispatch the goods. We reserve the right to decline an order without giving reasons; in that case, any payments already made will be refunded without delay.

We store the text of the contract and send it to you by email together with these terms. The contract languages are German and English.

4. Prices and payment

All prices shown are final prices in euros and include statutory VAT. Shipping costs are shown separately during checkout and displayed before you complete your order. The price shown at the time of your order applies.

The payment methods offered at checkout are shown to you before you complete your order. Payment is due when the contract is concluded.

5. Delivery

We deliver to all EU member states except Malta and Cyprus. Processing usually takes 1 business day. The stated delivery times (Austria 1–2 business days; Germany, Czechia, Poland, Italy and the Netherlands 3–5 business days; rest of the EU 5–8 business days) are non-binding estimates. If an item is not available, we will inform you without delay and promptly refund any payments already made.

6. Retention of title

The goods delivered remain our property until paid for in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. The full withdrawal information, including the model withdrawal form, can be found under Refund policy.

8. Warranty

The statutory warranty rights apply. For consumers, the warranty period is two years from delivery of the goods. In the event of a defect, you are entitled to repair or replacement and, if that is not possible or not reasonable, to a price reduction or cancellation of the contract.

Please check the delivery on arrival and report any transport damage, if possible within 48 hours, to [email protected]. This request is not a condition of your statutory rights, but it helps us pursue the case with the carrier.

9. Liability

We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

10. Responsible consumption

Our products contain alcohol. Please enjoy them in moderation. Not suitable for pregnant or breastfeeding women or persons under 18. No alcohol when driving.

11. Use of the website

All content on this website – in particular texts, images, graphics, logos and trademarks – is protected by copyright and may not be reproduced, distributed or otherwise used without our prior written consent. Automated access that circumvents security measures or access restrictions is prohibited.

12. Data protection

13. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body. If you have questions or complaints, you can reach us at [email protected].

14. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence. The place of jurisdiction for consumers is the one provided for by law. For businesses, the competent court in Salzburg, Austria, has exclusive jurisdiction.

15. Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provisions.

The version of these terms published at the time of your order applies. The current version can be found on this page at any time.
